Fence Requirements

For the record, the Board has clarified the size of fencing allowed in the development.

Resolution: June 15, 2007


WHEREAS, Hawkins Run Property Owners restrictive covenants established architectural control in article VI of the Declaration of Covenants, Conditions, and Restrictions, recorded in book 347, page 56, Lee County, NC.

WHEREAS, the Board is charged with the responsibility to ensure restrictive covenants are properly defined and complied with, within reason.

WHEREAS, the Board desires to set out, more specifically, FENCE GUIDELINES.

NOW, THEREFORE, BE IT RESOLVED, that the Board has established that fences constructed from this day forward in Hawkins Run, will conform to the following:

1. Invisible fences and/or

2. Picket fences:

2.1 The homeowner is required to fill out and submit an Architecture Request form and receive approval from the Architecture Committee in writing prior to erecting a fence.

2.2 Fences shall be constructed only along the property border of the back and side yards. The returns to the house may be no further than the mid-point between the front and back faces of the house, not including the garage.

2.3 Fences that do not border another Hawkins Run property, such as those that border Hawkins Avenue or Charleston Place homes, shall be constructed of 1” x 6” pine or cedar wood pickets, finished naturally or pressure treated, with dog-eared top edges, and the overall height shall be six (6) feet tall.

2.4 Fences that border another Hawkins Run property, and returns to the house shall be constructed of separated wood or metal pickets, and the overall height shall be forty-eight (48) inches tall. Wood pickets shall be constructed of 1” x 4” pine or cedar, finished naturally or pressure treated, have dog-eared or pointed tops, and the spacing between pickets shall be from one (1) inch to two (2) inches. Metal pickets shall be no greater than one (1) inch square, black, and the spacing between pickets shall be from three (3) to four (4) inches. Metal fences may have a wooden transition segment no greater than eight (8) feet long at the corner where the side fence meets the back fence.

2.5 Gates are permitted on side returns only.

2.6 Fences shall be constructed with pickets on the outside of the rails, "finished" side facing out.

BE IT FURTHER RESOLVED, that the Board, through cooperation and community spirit efforts shall seek compliance with this Resolution, but may use whatever means is authorized by the Covenants.
